These terms apply when you use Nephomancy at nephomancy.com (the “service”). By using the service you agree to them. If you do not agree, please do not use it.
1. Who we are
Nephomancy is operated by Dave Holliday, a sole trader based in the United Kingdom (“we”, “us”). You can contact us at [email protected].
2. What Nephomancy is, and is not
Nephomancy is for entertainment and reflection. You photograph the sky and an AI system writes a short, personalised reading in the spirit of cloud divination (nephomancy).
- A reading is creative writing. It is not a prediction, and it is not advice of any kind.
- Do not rely on a reading to make decisions about your health or medical care, money or investments, legal matters, safety, or relationships. Speak to a qualified professional about those.
- Readings are generated by AI and can be wrong, odd or repetitive. We do not promise they are accurate, complete or suitable for any purpose.
3. Your account
- You can start without signing up: we create an anonymous account for your device. To keep your readings across devices, or to subscribe, you sign in with a link we email to you.
- You must be at least 16 years old to use the service.
- You are responsible for your device and email account. Tell us promptly if you think someone else has access to your account.
4. Your photos and content
- Only upload photos you have the right to use, and photos of the sky. Do not upload anything unlawful, or anything that shows other people without their permission.
- You keep ownership of your photos and diary entries. You give us a limited licence to process them solely to provide the service to you (for example, sending a photo to an AI model to write your reading).
- You may use and share your readings for personal, non-commercial purposes.
5. Acceptable use
You must not misuse the service. In particular, do not: use bots or scripts to access it; try to get around the daily limits, human check or other safeguards; attempt to disrupt, overload or break into the service; scrape or resell readings; or use the service to harass or harm anyone.
6. The free plan
The free plan includes a limited number of readings per day. A “day” is your own local calendar day. We may change these limits, and the features of each plan, from time to time.
7. Plus subscriptions
- Plus is a paid subscription with monthly or annual billing. Current prices are on the Pricing page. The price you see at checkout is the price you pay.
- Your subscription renews automatically at the end of each period until you cancel. We charge your payment method through Stripe.
- You can cancel at any time from the Manage subscription button in the app. You keep Plus until the end of the period you have paid for.
- If we change the price, we will tell you at least 30 days before your next renewal, and you can cancel before it takes effect.
- If a payment fails, Stripe may retry it. If it still fails, your Plus access will end.
- Refunds are covered by our Refund Policy.
8. Availability and changes
We aim to keep the service running but cannot promise it will always be available or error-free. It relies on third-party services, including AI models. We may change, suspend or stop any part of the service, and we will give notice where we reasonably can.
9. Our responsibility to you
- Nothing in these terms limits any liability that cannot legally be limited, including for death or personal injury caused by negligence, for fraud, or your statutory consumer rights.
- Subject to that, and to the extent the law allows, we are not responsible for indirect or consequential loss, or for any decision you make or action you take because of a reading.
- Subject to the first point, our total liability to you for anything connected with the service is limited to the amount you paid us in the 12 months before the claim.
10. Ending your use
You can stop using the service at any time, and you can ask us to delete your account (see Privacy Policy). We may suspend or close an account that breaks these terms, after warning you where that is reasonable.
11. Changes to these terms
We may update these terms. We will post the new version here with a new date, and we will email subscribers about significant changes. Using the service after a change means you accept it.
12. Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, although if you are a consumer you may also have the right to bring a claim in your home country and to rely on its mandatory consumer protections.
